Article 1: General provisions

The e-commerce website of Boho Strings, a non-profit organization with its registered office at Luitenant Lippenslaan 22, 2140 Borgerhout, VAT BE 0568.669.131, (hereinafter "Boho Strings") offers its customers the possibility to purchase products from its webshop online.

The present General Terms and Conditions ("Terms and Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order through Boho Strings' online store, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, except when they have been previously, in writing and expressly accepted by Boho Strings.

Article 2: Price

All prices stated are expressed in EURO and always include VAT and all other compulsory charges or taxes to be borne by the Customer.

The price stated relates exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes only and may contain elements that are not included in the price.

Article 3: Offers

Despite the fact that the online catalog and the e-commerce website are composed with the utmost care, it is still possible that the information is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind Boho Strings. Boho Strings is regarding the accuracy and completeness of the offered information only bound to a means obligation. In no event shall Boho Strings be liable for manifest material errors, misprints or printing errors.

The offer is always valid while stocks last and can be modified or withdrawn by Boho Strings at any time. Boho Strings can not be held responsible for the unavailability of a product.

Article 4: Online purchases

The ordering procedure is as follows: the customer presses the "Buy Now" button and is redirected to the Paypal payment site. The Customer must make the payment, after receiving the invoice, in order to ship the order. Costs, related to the payment are for Boho Strings.

Boho Strings is entitled to refuse an order due to a serious shortcoming of the Customer with respect to orders involving the Customer.

Article 5: Delivery and performance of the agreement

All music scores ordered through this web store will be delivered worldwide as a PDF document via email. CDs, and other physical items, are delivered in the European Union via Bpost, DHL or another parcel service and for this the Customer pays additional costs, as stated in the order procedure.

Unless otherwise agreed or expressly provided, the goods will be delivered to the Customer's residence within 30 days of receipt of the order.

The Customer must carefully inspect the order immediately upon receipt. Complaints regarding the order, shall be made in writing or by e-mail info@bohostrings.com, at the latest within 7 days after receipt of the order.

The risk of loss or damage shall pass to the Customer as soon as he (or a third party appointed by him, who is not the carrier) has received physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier was instructed by the Customer to transport the goods and this choice was not offered by Boho Strings.

Boho Strings can never be held liable for any damage -loss or theft included- that occurs to the products or packaging upon return.

Article 6: Retention of Title

The delivered articles remain the exclusive property of Boho Strings until the moment of full payment by the Customer.

The Customer undertakes, if necessary, to inform third parties of Boho Strings' retention of title, e.g. to anyone who might come to seize the articles that have not yet been paid for in full.

Article 7: Right of withdrawal

The law "remote sales" provides the right to cancel the sale within a period of 14 calendar days after purchase, counting from the day after delivery to the consumer. Thus, the consumer can exercise the right of withdrawal. The purchased product can be exchanged or returned complete and unused in the original undamaged packaging (as far as possible). The costs of returning an article are to be borne by the Customer. Items must be shipped in equally sturdy packaging so that they arrive at Boho Strings undamaged. If the consumer has paid a pro forma sum, Boho Strings will refund this sum as soon as possible, but no later than 30 days after the return of the article, in the same way as we have received the payment.

Article 8: Guarantee

Under the Act of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact Boho Strings and return the item to Boho Strings at its expense.

In the event that a defect is identified, the Customer shall notify Boho Strings as soon as possible. In any event, any defect must be reported by the Customer within a period of 2 months after its discovery. After that, every right to repair or replacement expires.

The (commercial and/or legal) guarantee is never applicable to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that become apparent after a period of 6 months following the date of purchase, or delivery as the case may be, are not considered to be hidden defects, unless proven otherwise by the Customer.

Article 10: Privacy

Boho Strings observes the applicable laws and regulations when processing the data of the Customer.

Boho Strings will under no circumstances sell or disclose the Customer's email address, nor pass on personal information to any third party, with the exception of third parties engaged for the delivery of ordered goods.

Article 11: Infringement of validity - non-waivers

If any provision of these Terms and Conditions is declared invalid, unlawful or void, this shall not in any way affect the validity, legality and applicability of the other provisions.
The failure at any time by Boho Strings to enforce any of the rights enumerated in these Terms and Conditions, or to exercise any right hereunder, shall never be construed as a waiver of such provision and shall not affect the validity of such rights.

Article 12: Applicable law - Disputes

All offers and agreements are governed exclusively by Belgian law.

The applicability of the Vienna Sales Convention (CISG) is expressly excluded.

All disputes relating to or arising from offers made by Boho Strings or agreements entered into with Boho Strings will be submitted to the competent court in Antwerp, unless a mandatory provision of the law expressly designates another court as competent.
